These general terms and conditions of use (the so-called “CGU”) are the legal framework for the terms and conditions of availability of the site and services by Akaze and the conditions of access and use of services by the user.

Any registration or use of the site implies acceptance without any reservation or restriction of these CGUs by the user. When registering on the site via the registration form, each user expressly accepts these Terms and agrees to respect them.

In case of non-acceptance of GTCs stipulated in this contract, the user must waive the access of the services offered by the site.

Akaze reserves the right to unilaterally and at any time modify the content of these CGUs.

ARTICLE 2 – ACCESS TO THE SITE

The site is free of charge to any user with Internet access. All user-supported fees to access the service are at its expense.

The user agrees to provide sincere and accurate information about his civil status and contact information, including his email address.

Any member user may also request his or her withdrawal by applying to contact@akaze.fr. This will be effective within a reasonable time frame.

The member user, by creating an account, accepts the following:

1. The Member User is the only person responsible for their account, security and confidentiality, including passwords or personal information on this account
2. All personal information that the user will provide through their account is up-to-date, accurate and truthful, and agrees to update their personal information if they change.

Akaze reserves the right to suspend or terminate an account if a user uses the site illegally or if it violates the acceptable terms of use.

A user agrees to use the Akaze site legally, it includes but is not limited to:
- Violating the rights of other users of the site
- Violate the intellectual property rights of site owners or any third party at the site
- Pirater the account of another site user
- Act in any way that could be considered fraudulent
- Participate in any illegal activity on the site

Any event due to a case of force majeure resulting in a dysfunction of the site or server and subject to any interruption or modification in the event of maintenance, does not assume responsibility for Akaze. In these cases, the user agrees not to hold the publisher any interruption or suspension of service, even without notice.

ARTICLE 3 – COLLECTION OF RELATED

The site provides the user with a collection and processing of personal information in accordance with the law No. 78-17 of 6 January 1978 on computers, files and freedoms. By virtue of the Law on Information and Freedoms, dated 6 January 1978, the user has a right to access, rectify, delete and oppose his personal data. The user exercises this right by email at contact@akaze.fr.

ARTICLE 4 – INTELLECTUAL PROPERTY

The trademarks, logos, images, documentation, as well as all the content of the site are protected by the Intellectual Property Code and in particular by copyright.

Any reproduction and/or representation and/or partial or total exploitation of the products of Akaze, of any kind, is totally prohibited.

Any total or partial representation of this site by any process, without the express authorization of the operation of the website would constitute a counterfeit sanctioned by article L 335-2 et seq. of the Intellectual Property Code.

It is recalled in accordance with Article L 122-5 of the Intellectual Property Code that the user who reproduces, copies or publishes the protected content must cite the author and its source.

ARTICLE 5 – RESPONSIBILITIES

The sources of information on the Akaze site are deemed reliable, but the site does not guarantee that it is free from defects, errors or omissions.

The information provided is provided in an indicative and general manner without a contractual value. Despite regular updates, the Akaze site cannot be held responsible for amending legal and administrative provisions after publication. Similarly, the site cannot be held responsible for the use and interpretation of the information contained in this site. The user makes sure to keep his password secret. Any disclosure of the password, whatever its form, is prohibited. It assumes the risks related to the user of its ID and password. The site is not responsible.

The Akaze site cannot be held responsible for any viruses that could infect the computer or any computer equipment of the Internet user, as a result of any use, access, or download from this site.

The liability of the site cannot be incurred in the event of force majeure or the unpredictable insurmountable fact of a third party.

If, at any time, any of its provisions set out in this document are deemed incompatible or invalid under the applicable laws, these provisions shall be considered null and void and shall be removed from this document. All other provisions will not be affected by the laws and the rest of the document will always be considered valid.

ARTICLE 6 – HYPERTEXT LINKS

Hypertext links can be found on the site. The user is informed that by clicking on these links, he will exit the Akaze site. The latter has no control over the web pages on which these links are produced and cannot, in any case, be held responsible for their content.

ARTICLE 7 – COOKIES

The user is informed that when visiting the site, a cookie can automatically install on its navigation software.

Cookies are small files stored temporarily on the hard drive of the user’s computer by your browser and which are necessary for the use of the Akaze site. Cookies do not contain personal information and cannot be used to identify someone. A cookie contains a unique identifier, randomly generated and therefore anonymous. Some cookies expire at the end of the user’s visit, others remain.

The information contained in cookies is used to improve the Akaze website. By browsing the site, the user accepts them. The user will be able to disable these cookies through the settings in their navigation software.

ARTICLE 8 – APPLICABLE LAW AND COMPETENT LEGMENT

French legislation applies to this contract. In the event of a lack of amicable resolution of a dispute between the parties, the French courts will be solely competent to bring a problem to a conclusion.
